Sexual harassment happened daily, new workplace lawsuit states

It is disappointing to know that women and men continue to be victims of sexual harassment in the workplace. Sexual harassment is illegal, but every year more incidents are reported in California and throughout the entire country. Some complaints are handled appropriately and immediately by employers. Unfortunately, other complaints are ignored until workers decide to take legal action.

Last week, an amended lawsuit was filed against Senor Frog’s in Hawaii. The lawsuit stems from an employee complaint that was first made in April 2008. The employee had reported several incidents of sexual harassment in the workplace to the U.S. Equal Employment Opportunity Commission. Now the commission is accusing the woman’s former employer of sexually harassing at least eight other employees.

The employees who were sexually harassed are all women and they all worked at a Senor Frog’s located in Waikiki. Because the restaurant’s parent company is located in Mexico, the EEOC said that it can only pursue legal action against the company’s unit that is based in Hawaii.

According to the lawsuit, three of the company’s senior executives and at least five managers are accused of sexually harassing nine female employees, including employees who were younger than 20 when the harassment occurred. The managers and executives are accused of touching workers’ breasts and requesting workers to have sex with them. The victims also endured offensive comments made by managers on a daily basis, the lawsuit states.

The restaurant where the harassment occurred closed down for business in August. Victims are seeking compensation for punitive damages and lost wages. The EEOC is also requesting that the company modify its policies and provide adequate training for employees in order to make sure this type of illegal behavior is never tolerated again.
