Employee accuses California healthcare facility of discrimination

A certified nursing assistant has filed a lawsuit in the U.S. District Court for the Northern District of California that accuses his employer of discrimination based on national origin. According to WestLaw News & Insight, the employee accuses his California employer, Kindred Healthcare Operating Inc., of a pattern of discrimination and harassment based on his Filipino origin.

The man worked at the Kindred-operated Tunnell Center for Rehabilitation and Healthcare. The lawsuit also names as defendants Kindred Hospitals West L.L.C. and Kindred Nursing Centers West L.L.C.

The employee says that his civil rights were violated when his employer falsely accused him of abusing a resident at the long-term-care facility and terminated him. The facility rehired the man three days after firing him. The employee also accuses his employer of retaliation for his complaints of discrimination.

The worker says that he suffered loss of earnings and benefits because of this employer's discriminatory employment practices. He also claims that he suffered emotional distress and has had to undergo psychotherapy.

He accuses his employer of violating his rights to equal employment guaranteed under California's Fair Employment and Housing Act. According to WestLaw News & Insight, the U.S. Equal Employment Opportunity Commission issued a right-to-sue notice to the worker last fall.
